The Building Safety Act 2022
Post-Grenfell (another blog post we have featured here about the poignant Memorial Wall), fire safety regulations were rightly tightened and the Building Safety Case reports took on additional significance as part of the Building Safety Act of 2022.
The law on Building Safety Case Reports in the UK was introduced under the Building Safety Act 2022, which aims to improve accountability and transparency in managing higher-risk buildings. A Building Safety Case Report is a legally required document for occupied residential buildings over 18 metres or seven storeys. It must set out how fire and structural safety risks are identified, managed, and mitigated, providing evidence that the building is safe for residents.
The report is submitted to the Building Safety Regulator and forms the basis for obtaining a Building Assessment Certificate. Dutyholders, such as accountable persons and principal accountable persons, are legally responsible for preparing and maintaining the report. Failure to comply can lead to enforcement action, fines, or criminal liability.
The legislation ensures that building owners and managers take a proactive approach to safety, placing residents’ welfare at the centre of building management.
